Defendant Chang Hao, male, born on October 12, 1978, citizen identification number (omitted), Han ethnicity, junior high school education, registered residence in Zhenxiong County, Zhaotong City, Yunnan Province, residing at the same address. Suspected of committing the crime of picking quarrels and provoking trouble, he was criminally detained by the Zhenxiong County Public Security Bureau on April 15, 2023. Our office approved his arrest on May 15 of the same year, and the Zhenxiong County Public Security Bureau executed the arrest on the same day. He is currently detained at the Zhenxiong County Public Security Bureau Detention Center.

The case was concluded by the Zhenxiong County Public Security Bureau, and Chang Hao was transferred to our office on May 22, 2023, for prosecution on suspicion of picking quarrels and provoking trouble. After accepting the case, our office informed the defendant on May 23, 2023, of his right to appoint a defense attorney and the legal consequences of pleading guilty and accepting punishment. We legally interrogated the defendant, listened to the opinions of the defendant and his defense attorney, and reviewed all case materials. Due to unclear facts and insufficient evidence, our office returned the case to the Zhenxiong County Public Security Bureau for additional investigation twice, on June 29 and September 8, 2023. The Zhenxiong County Public Security Bureau resubmitted the supplemented investigation to our office on July 24 and October 8 of the same year. Due to the complexity of the case, our office extended the review and prosecution period by fifteen days on June 21 and August 24, 2023. The case has now been concluded after review.

Upon legal examination, it was ascertained: From October 2022 to April 2023, Chang Hao repeatedly published and forwarded false information and inappropriate remarks on the internet, causing serious disruption to public order and having a negative social impact.

The evidence confirming the above facts includes:

  1. Case filing decision and other documentary evidence; 2. Electronic data; 3. Physical evidence, an Apple iPhone 11; 4. The defendant’s statements and defenses.

Our office believes that the defendant Chang Hao’s actions in spreading false information on the internet, causing serious disruption to public order and having a negative social impact, have violated the provisions of Article 293, Paragraph 1 of the Criminal Law of the People’s Republic of China. The facts of the crime are clear, and the evidence is real and sufficient. He should be held criminally responsible for the crime of picking quarrels and provoking trouble. According to Article 176 of the Criminal Procedure Law of the People’s Republic of China, a public prosecution is initiated. Please sentence him according to the law.
